The Regional Transport Office (RTO) in India operates under the framework of the Motor Vehicles Act, 1988, and the Central Motor Vehicles Rules, 1989

. These regulations mandate, among other things, that all vehicles must be registered, possess valid insurance, and undergo emissions tests. Key terms and conditions for various RTO services are outlined below.

Vehicle Registration (New Vehicles)

  • Dealer Delivery: Dealers cannot deliver a vehicle without registration; they must register it in the customer's name first.
  • Temporary Registration: Valid for only one month, within which time a permanent registration number must be obtained.
  • Documentation: Required documents include proof of address, identity, sale certificate (Form 21), roadworthiness certificate (Form 22), and insurance. 

Vehicle Transfer (Ownership)

  • Timeline: Application for transfer of ownership must be submitted within 14 days of purchase.
  • Penalty: A penalty of Rs. 500 per month is charged for delays in application.
  • Documents: Original Registration Certificate (RC), Forms 29 and 30, valid insurance, pollution certificate, and proof of address.
  • Death of Owner: Requires a succession certificate or survivor certificate if applying as a nominee. 

Vehicle Inspection and Fitness

  • Transport Vehicles: Must undergo a mandatory fitness test every year after the initial two years.
  • Emission Tests: Mandatory, with free acceleration smoke tests required every six months after one year of initial registration.
  • Expired RC: For private vehicles, the RC is valid for 15 years, then requires renewal every five years. 

Relocation and NOC (No Objection Certificate) 

  • Inter-state Movement: An NOC is required to transfer registration from one state to another.
  • Re-registration: The vehicle must be re-registered at the new RTO within 1 month of the NOC issuance.
  • NOC Cancellation: Can be cancelled within 3 months if the vehicle was not registered in the new state, provided the original NOC and a non-utilization certificate are submitted. 

Common Fines and Penalties (2026 Regulations)

  • Expired RC: Fines up to ₹5,000 for the first offense and up to ₹10,000 for subsequent offenses.
  • No PUC Certificate: ₹10,000 fine.
  • Driving Without License: ₹5,000 fine.
  • Triple Riding: ₹1,000 fine.
  • Tinted Glass: ₹500 - ₹1,500 fine.
  • No Insurance: ₹2,000 - ₹4,000 fine. 

Other Rules

  • Driving License: RTOs issue and renew licenses, and can suspend/cancel them for traffic violations.
  • Commercial Vehicles: Require specific permits and fitness certificates, with additional fees for delayed renewal.
  • Scrapping Policy: Unfit and polluting vehicles are subject to the Registered Vehicle Scrapping Facility (RVSF) norms.
